Overview of Bill 46 changes

This webpage, curated by the CCOA, lists which documents have been affected by Bill 46 legislation. This webpage describes where regulated member requirements were housed and where they will be going forward, in the new legislation or in CCOA governance documents.

All of the documents noted below can be found in the Protecting the Public section, with the exception of the Continuing Competence Program Manual which is found in the Competence section. Description of changes

SP 1.3 Use of Protected Title
This standard ensures that regulated members use the appropriate title when referring to themselves. This includes the use of the word specialist. Only chiropractors with a current registration with the specialty colleges may refer to themselves and the care they provide as specialists or specializing.

SP 4.1 Scope of Practice for Chiropractors
To accommodate the development of proposed Standard of Practice 4.9 Performance, Authorization, Competence and Supervision of Restricted Activities, Standard of Practice 4.1 was modified to remove restricted activities.

This standard describes activity under restricted activities as defined in legislation.

SP 8.4 CCOA Radiation Health and Safety Program
This standard of practice was updated to reflect the change in the governing legislation.

SP 10.0 Continuing Competence Program
This Standard establishes regulated member requirements for continuing competence.

SP 11.0 Concluding a Patient Relationship
This standard clarifies when it is appropriate to conclude a patient relationship.  Clarity is provided as to the requirements that apply. 

Code of Ethics changes

Description of changes

Bylaw 6.1 Applications for Registration on the General Register

This new bylaw is due to the change of Section 28 of the HPA; the registration requirements in an application for registration under that section are now set out in a College’s Bylaws instead of regulations.

Bylaw 6.3 Applications for Registration on the Specialty or Acupuncture Register
This new bylaw is for the provision of the requirements for regulated and courtesy members to be on The Specialty Register and The Acupuncture Register. The power of Council to make Bylaws concerning the use of the term “specialist” has been removed by deleting section 128(11). This term is now defined in the Standards of Practice.

Bylaw 6.6 Considerations of Application to College Registers
This new bylaw ensures that the registrar, registration committee or competence committee are designated to consider applications for practice permits and to impose conditions as per the HPA.

Bylaw 6.7 Use of the Title Specialist - Strike
The power of Council to make Bylaws concerning the user of the term “specialist” has been removed by deleting section 128(11)(see page 89 of Bill 46). This term is now defined in the Standards of Practice.

Bylaw 6.8 Publishing of the College Registers
This is a numbering and naming change, to move the current Bylaw 6.1 Applications on the General Register to Bylaw 6.8 Publishing of the College Registers. The publishing requirements are removed from the regulations.

Bylaw 8.2 Continuing Competence Program Requirements
This new bylaw represents the transition of the CC program from the Regulations to Bylaws/Standards of Practice as required by Bill 46.

Bylaw 8.3 Competence Committee
This new bylaw is due to Bill 46 transitioning the Continuing Competence Program requirements to the Standards of Practice. Part of that introduction is the Council provided Continuing Competence Program Manual. A Bylaw to authorize the Competence Committee to conduct these activities is recommended to ensure that the authorization is established.

Struck due to redundancies. This content is mentioned in Bylaw 6.6 and AP 1.3.
